Terms of Service

1. Who we are

FormTune, the website at formtune.app and its web app, is a service operated by Dexaro kj OÜ (registry code 17547926), a private limited company registered in the Estonian Commercial Register, with its registered address at Hooldekodu tee 23a-48, 13914 Tallinn, Harju maakond, Estonia. In these terms, "we", "us" and "our" mean Dexaro kj OÜ, and "you" means the person using the service. You can reach us at support@formtune.app.

2. Eligibility

You must be at least 16 years old, or the minimum age of digital consent in your country if that is higher, to create an account. By using the service you confirm that you meet this requirement and that the information you give us is accurate.

FormTune is not available to anyone resident or located in Russia, Belarus, Iran, North Korea, Syria or Cuba. We refuse access from those six countries by IP address and do not open accounts for email addresses registered there.

3. Business customers

Businesses may use FormTune and buy credits. If you create an account, buy credits or use the service for or on behalf of a company, partnership or other organisation, you confirm that you have the authority to bind that organisation to these terms, and "you" then includes that organisation. Rights that the law gives only to consumers do not apply to purchases made as a business.

4. Your account and security

You are responsible for keeping your login details confidential and for all activity that happens under your account. Please give accurate account details and keep them up to date. Tell us promptly at support@formtune.app if you think your account has been accessed without your permission. You may delete your account at any time from Settings.

5. How the service works

FormTune lets you upload or describe a rep, movement or technique and returns AI-generated feedback on your form. Results are informational coaching aids only. You remain responsible for deciding whether any exercise, movement or suggestion is safe and appropriate for you, and for training within your own ability and any medical guidance you have received.

6. Credits and how they are spent

FormTune runs on credits. You spend credits when you run an action, such as an analysis. New accounts may receive welcome credits to try the service. Credits are deducted only when an action succeeds; if an action fails, any credits reserved for it are released back to your balance. Credits have no cash value, are not money, a deposit or a stored-value instrument, are non-transferable between accounts, do not expire while your account is open, and cannot be exchanged for cash except where we are legally required to refund an eligible purchase.

7. Buying credits

Where card purchases are available, you buy credits in one-time packs or as a custom amount — there is no subscription and no recurring billing. You choose to pay in euros (EUR) or US dollars (USD), and a single top-up can be from €1 to €20,000, or from $1 to $20,000. Some purchase options may be shown as coming soon. 8. Hiring a fitness coach

Besides AI feedback, you can hire one of our vetted fitness coaches to review your form in writing (1000 credits) or to run a 30-minute live session with you (1500 credits). You can ask for the first available coach or choose a particular one.

Our coaches are independent professionals who have applied, had their identity and experience checked by us, and agreed to our Specialist Terms. They give technique guidance, not medical advice. You pay us in credits and never pay a coach directly; if a coach asks you to pay them outside the service, please tell us.

When you send a request, its price is held from your credit balance (escrow). Held credits cannot be spent elsewhere but are not taken. They are taken only when you accept the coach's delivery, or automatically seven days after delivery if you neither accept it nor raise a problem. If no coach accepts your request within seven days, or you cancel it before one does, the hold is released in full. If you raise a problem with a delivery, the credits stay held while our team reviews it and decides whether to pay the coach or release them to you.

The coach who accepts your request can see the notes and any clip you attached to it, and uses them only to do that request. Please attach only content you are happy for them to see.

9. Acceptable use

You agree not to: upload content you do not have the right to use; upload content that is unlawful, infringing or harmful, or that depicts other people without their consent; use the service to break the law, harass others or infringe anyone's rights; attempt to reverse engineer, scrape, overload, disrupt or gain unauthorised access to the service or its systems; resell or commercially exploit the service or credits without our written permission; or misuse promotional credits, refunds or other features. We may investigate suspected breaches and take proportionate action.

10. Your content and the licence you give us

You keep ownership of the media and text you submit. To operate the service, you grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, process and transmit your content solely to provide the service to you and generate your results — including sending it to the AI providers who act as our processors. This licence ends when your content is deleted from the live service, except for backups or records we are legally required to keep. We do not use your content to advertise to third parties, and we do not sell it.

You own the results we generate for you from your content (scores, feedback, drills and any other output of an action you run), subject to any rights of the AI providers whose models we use to generate them and to the acceptable-use limits in these terms. You are responsible for how you use those results.

11. AI-generated results

Results are generated by AI and are provided for general information and coaching purposes only. They are not professional, medical, physiotherapy, fitness-certification or safety advice, and they are not a substitute for guidance from a qualified professional. AI output can be incomplete, inaccurate or unsuitable for your situation. Always use your own judgement, and consult a suitably qualified professional before acting on any result, particularly if you have an injury or health condition. We do not guarantee any particular result or outcome.

12. Intellectual property

The FormTune name, software, design, text and other materials we provide are owned by Dexaro kj OÜ or our licensors and are protected by intellectual property laws. We grant you a personal, non-transferable, revocable licence to use the service for its intended purpose while these terms are in force. You may not copy, modify, distribute or create derivative works from our materials except as these terms allow or the law permits.

13. Third-party services

We rely on third parties — including AI model providers, hosting, analytics and payment providers — to deliver the service. How they handle personal data is described in our Privacy Policy. We are not responsible for third-party websites or services we may link to but do not control.

14. Availability and changes to the service

We work to keep the service available but do not guarantee it will be uninterrupted or error-free. We may add, change, suspend or remove features, and carry out maintenance, at any time. Where a change materially reduces a feature you have spent credits to use, we will act reasonably and in line with our Refunds & Cancellations policy.

15. Disclaimers

To the fullest extent permitted by law, the service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of satisfactory quality, fitness for a particular purpose and non-infringement. Nothing in these terms affects any statutory rights you have as a consumer that cannot be excluded or limited.

16. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, data or goodwill, or for any injury or loss arising from your reliance on AI-generated results. Our total liability to you for any claim is limited to the amount you paid us for credits in the three months before the event giving rise to the claim. Nothing here excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded under the laws of the Republic of Estonia.

17. Indemnity

You agree to indemnify us against reasonable claims, losses and costs arising from your breach of these terms, your misuse of the service, or content you submit that infringes someone else's rights or the law.

18. Suspension and termination

We may suspend or close your account if you seriously or repeatedly breach these terms, if required by law, or to protect the service or other users. Where it is reasonable to do so, we will give you notice. You may stop using the service and delete your account at any time. Sections that by their nature should survive termination — such as those on liability, intellectual property and governing law — will continue to apply.

19. Changes to these terms

We may update these terms from time to time. The “Last updated” date above shows when we last did. Where changes are material, we will take reasonable steps to let you know. Continuing to use the service after an update means you accept the revised terms.

20. Governing law and disputes

These terms and any dispute arising from them are governed by the laws of the Republic of Estonia, without regard to conflict-of-law rules, and Harju County Court (Harju Maakohus), Estonia has jurisdiction over any dispute. If you are a consumer, you retain the benefit of any mandatory consumer-protection provisions of the law of your own country of residence, and nothing in these terms affects those rights.
